Who you are dealing with
Build This Plan is operated by Bite Media LLC(“we”, “us”). Using the site, buying a plan or making an account means you accept these terms and our privacy policy. You must be 18 or older to buy or to make an account. Contact:hello@buildthisplan.com.
What the site is, and is not
A catalog of house plans drawn by named designers, sold as licenses, and a way to be introduced to builders and other pros near where you are building, where any on the site cover your lot. We are not a party to any contract you make with a builder, designer, engineer or other pro, and we do not guarantee their work, prices or schedule. Builders and pros on our lists are independent businesses. Brixton Development, which is affiliated with the site, appears on those lists on the same terms as everyone else, and the affiliation is shown wherever it does.
We do not provide engineering. Plans are not sealed by an engineer. In Texas, among other cases, a residential slab on expansive soil needs a foundation designed and sealed by a Texas licensed professional engineer. When you ask, we put you in touch with an independent engineer who quotes and bills you directly; we take no fee or commission from them. Meeting your local code, getting permits, and any engineering, survey or site work are yours to arrange.
We work to list every plan accurately, including what each drawing set leaves out. If you find a number on a plan page that does not match its drawing set, tell us and we will fix it. Plate illustrations are illustrative renderings, not photographs of built homes.
Buying a plan
- You buy a license to use the designer's drawings, not the design itself. The designer keeps the copyright. What each license tier allows is set out on plan licensing, and those terms are part of these.
- A single build license lets you build one house at one address, have it modified by licensed professionals to meet your local code, give copies to your builder, engineer and permit office for that project, rebuild at the same address if the house is destroyed, and sell the finished house.
- No license lets you resell, share or give away the files, claim the design as your own, or remove the copyright notice. A single build license does not let you build it a second time.
- Every delivered set is stamped with the buyer's name, the address on file, the license and the order number. Removing or altering the stamp breaks the license.
- Prices are in US dollars and are charged through Stripe when you check out. All sales are final once the files are released, because files can be copied. Download links expire; your account lets you download the stamped set again.
Asking for changes
You can ask a plan's designer for changes before you buy. The designer quotes a price and a time in the thread. If you accept, you pay for the plan and the changes in one checkout, the designer draws them, and the revised set is delivered from the thread and stamped like any other. The revised set is licensed under the tier you chose. Changes that need an engineer are handled as described above.
Some designers also offer alterations at fixed prices they set, chosen with the plan and paid in the same checkout. The plan is delivered at once; the alterations open a thread like a quoted change, and the revised set is delivered from it.
Every paid alteration or quoted change has a due date: the turnaround the designer set, counted in business days (Monday to Friday, Texas time) from payment. Both of you see it in the thread. The designer may ask you for a later date with a reason; if you accept, that becomes the due date, and if you decline, the date stands. If the revised set is not delivered within 3 business days after the due date, you may cancel the alterations or changes in the thread and the full price of that part is refunded to your card. You keep the plan license (for a quoted change, the original set is delivered then), and the designer is not paid for the cancelled part. Nothing else about the order is refunded by this.
Accounts
Give us your real name and an email you can reach, keep your password to yourself, and tell us if someone else gets into your account. Plans bought with an email show in the account for that email once the email is confirmed. We may suspend or close an account that breaks these terms, misleads buyers, or misuses anyone's contact details.
For builders and other pros
- Your profile is public only after we approve it, and you are responsible for everything in it being true. Licenses, memberships and credentials are shown as you write them; we do not verify them.
- You see a buyer's project when they let the pros on their list see it and you were on that list, and their name, email and phone only after you ask for an introduction and they say yes to you. Use them only to talk with that buyer about their project. Never sell or pass them on. When a buyer turns contact off, the request shows as withdrawn; stop contacting them.
- Listing is free. Builders pay per lead: when a per lead price is in effect (your dashboard shows it), a builder is charged that price to the card they saved only when a buyer accepts their introduction, at the moment the buyer's details are released. Asking is free, and nothing is charged for a buyer who declines or does not answer. If the charge fails, the details stay held for 72 hours while you update your card, then the introduction lapses uncharged. At most three builders may ask about one project at a time. We may refund a charge for a lead that was not genuine. Other pros are not charged for introductions. We never take a commission from engineers or surveyors.
For designers who sell here
- You confirm you own the copyright in every plan you send, or have the right to license it. You give us a non exclusive right to show the plan, its renderings and details, and to sell licenses to it at the prices you set, for as long as it is listed. You keep the copyright and can sell the plan anywhere else.
- A plan goes live only after we check its numbers against the drawing set. After approval, changes to the plan go through us; you can change its prices any time.
- You are paid 70 percent of each plan sale and 90 percent of each change quote or alteration you draw, after card processing fees, through Stripe Connect to your own Stripe account. Your share is held as pending until you finish Stripe's onboarding. The terms on sell your plans are part of these.
- Deliver the changes you quote, and the alterations you offer, by their due date (payment plus the business days you set, or a later date the buyer accepted). Revised sets are stamped and sent to the buyer the moment you upload them. If one is more than 3 business days late, the buyer may cancel that part for a full refund of its price, and you are not paid for it; your share of the plan stands. You set every alteration price; we never set or change it. You may pause new alterations and change requests at any time, and they pause on their own while 2 or more of your jobs are overdue.
Limits
The site, the plans and the introductions are provided as they are. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim about a purchase is limited to what you paid us for it. Nothing here limits rights you have under law that cannot be limited.
